Notice of Contract Terms and Conditions concerning deposits, payments, cancellations, refunds and other responsibilities.
 
Definitions and Parties:
In this Contract ACompany@ means Tropical Escapes as well as Unique Vacations (saintluciavillas.com) a company owned by The French Connection Holding Corporation and organized under the laws of St. Lucia. AManagement@ means the on-island business or person representing the Property Owner. ACustomer@ means the person requesting the reservation and includes each and every person in the traveling party, regardless of the number, age or sex of the persons in the traveling party. (Note: Customer, by making deposit payment, represents and warrants that he is authorized to make such deposit and thereby accepts all the terms and conditions of this Contract on behalf of himself and every person in the traveling party.) AProperty@ means the Property Owner=s real property and vehicles as well as the rented premises including villas, rooms, resorts, accommodation services, and transportation services. Masculine gender includes both sexes and singular references include the plural at all times in this Contract.
 
Villa Booking Terms:
It is specifically understood and agreed by Customer that a deposit of 25% to 50% of the total rent must be paid within seven (7) days of making a reservation. This deposit must be made in U.S. dollars and is non-refundable. The remaining balance of the total rent must be paid in full at least sixty (60) days prior to Customer=s arrival date. Payment of the final balance of the total rent also must be paid in U.S. dollars and is only refundable within the absolute discretion of Management. The amount of such discretionary refund, if any, shall be determined by Management based upon Management=s ability to re-rent the Property for the same time period. No refunds will be made for early departure. Management=s decision concerning refunds is final. If a refund is made, a cancellation fee of $100.00 will be deducted from such refund by the Company. Some Management companies require signed open credit card authorizations against damages and/or phone charges. These open authorizations may be held as long as three months.
 
Hotel Booking Terms:
Hotel reservations are confirmed either with credit card information provided to hotels or payment to Tropical Escapes by credit card or cashiers check. The amount of the deposit is determined by hotel policy. Regardless of method of payment (by cashier=s check or credit card), the balance of the total rental must be paid in full at least sixty (60) days prior to Customer=s arrival date. Customer must provide the Company with a signed credit card authorization for reservations to be confirmed. Hotel deposits, cancellations and refunds are governed by the policies of the Hotel over which the Company has no control. All canceled reservations are subject to a $100 cancellation fee assessed by the Company.
 
Unauthorized Use of Property:
Customer understands and agrees that any unauthorized use of Property, such as use by persons not officially counted by Company as authorized members of Customer=s traveling party, constitutes a violation of this Contract and will result in eviction from the Property without refund.
 
Resolution of Disputes on Island:
Customer understands and agrees that all disputes or misunderstandings concerning availability, conditions or authorized use of the Property must be resolved with Management while Customer is on the island; and, that the terms of any dispute resolution are within the absolute discretion of Management. Customer also understands and agrees that Step By Step, Inc. has no legal authority to resolve such disputes or interfere with Management decisions. Customer agrees to resolve all disputes with Management BEFORE CUSTOMER LEAVES THE ISLAND.
 
Liability of company and Legal Jurisdiction:
This Contract is made in St. Lucia and Customer understands and agrees that this Contract shall be governed in all respects by and construed in accordance with the laws of St. Lucia. Customer also understands and agrees that legal jurisdiction concerning all matters pertaining to the meaning, performance or alleged breach of this Contract is vested in St. Lucia.

The Company acts only for other businesses providing accommodations and travel services. The Company does not assume any responsibility for and shall not be held liable for any injury, damage or loss to Customer or Customer=s personal property resulting from defects in any Property caused by acts, delays or failures of the employees, agents, servants or representatives of other businesses.

Customer understands and agrees that, when the Company dispenses vouchers or coupons for accommodations or transportation services, the Company is merely furnishing a convenience to Customer and that the Company is not acting as agent or representative of the other businesses offering or providing the services for which such vouchers or coupons are issued. Although the Company takes care to ensure that accommodations and services are in accordance with descriptions contained in brochures, the Company is not liable for any discrepancy between the actual accommodations or services provided and those described in a brochure. All information supplied is furnished Aas is@ with no warranties or representations concerning the quality, performance or fitness of the Property for a particular purpose. Information is furnished to the Company by others and is not always verified by the Company to insure accuracy. Customer understands and agrees that the Company is not liable for errors in or omissions of information concerning the Property, and that the Company is not liable for the failure of others to provide any services concerning the Property.

Customer understands and agrees that the Company is not responsible for injury, damage, loss, accident, delay and/or incidental expenses incurred by delay, change in schedule, sickness, weather, strikes, riots, political unrest or war. All such losses are the responsibility of Customer.
 
Travel Insurance:
Travel insurance to cover personal injury and damage to personal property or loss caused by accident or theft is recommended. Trip cancellation insurance is also recommended. Click here for details.
